AVR-Safeway Ltd. is not a broker
and takes legal ownership of the waste on acceptance in
the transfer station.
What does this mean?
According to EU Legislation, a licensed
transfer station is equivalent to a disposal or recovery
facility. In essence, once a transfer station accepts the
waste, it then effectively becomes the “producer”
of the waste and is now totally liable for that waste. Brokers
don’t offer any liability at all. Only AVR Safeway
offers public liability, marine liability and PALL of €13
million for each.
Arthur Cox Solicitors established that
an appropriate person can assume the legal ownership of
hazardous waste according to EU law.
The EPA confirmed that “AVR Safeway is an appropriate
person in accordance with Section 32(5) of the Waste Management
Act, 1996 for the collection, recovery and disposal of specified
waste”.
